Seems to me he's being hung, drawn and quartered by Abbott before there's any sort of judicial inquiry. The real 'joke' is that Turnbull was up for the same 'offence' but was allowed to keep working while it was sorted out!! Hypocrisy at its worst.

Kristy Fraser-Kirk files $35 million lawsuit against Mark McInnes and David Jones

She claims that during a lunch to celebrate a contract renewal between the retail giant and racing identity Gai Waterhouse, Mr McInnes urged Ms Fraser-Kirk to try a dessert by saying it was “like a f*** in the mouth”.

She also claims he put his hand under her clothes and touched her bra strap.

She claims he repeatedly asked her to accompany him to Bondi, where he lived, with “the clear implication that such a visit would be for the purpose of sexual intercourse”.

>>>>> >>>>>

Finally someone sues bigtime.
It was bound to happen.

So, she's suing for the 'touched' part?

She is suing Mr McInnes for $2 million punitive damages and the David Jones board for $35 million punitive damages. If she wins, it would be the first time punitive damages would be awarded for sexual harassment and misconduct in the workplace.

Ms Fraser-Kirk would donate any punitive damages to a charity.

She claims she suffered offence, humiliation, distress and anxiety and damage to her personal and professional reputation.

Surrounded by her family at a press conference this afternoon, Ms Fraser-Kirk said that she wanted to set up her own hotline for women who did not feel comfortable confiding in the company.

"This has been a devastating period in my life," she said.

>>>>> >>>>>

All fair enough by me.

The movie North Country starring the lovely Charlize as "Josey" showed it all...how sexual harassment laws were born in Minnesota in the mines and in court, in 1989, then spread throughout the world.

I say good on Ms Fraser-Kirk who incidentally has stated that any damages awarded will be given to charity. All businesses right down to the smallest of small business know all about "sexual harassment in the workplace" .... we are talking the CEO not a salesperson who might not be familiar with workplace laws (not having a go at salesperson BTW)....this grub was obviously a predator who thought he was beyond the law.....you go girl!!!!

apparently the idea of punitive damages is that it will hurt the defendant and they will put effort into this not happening agian...ie DJ's ignored her allegations....won't happen again if they have to pay huge amount...

"I was drunk, your Honour" stopped being able to be used as a defence in cases like this, in court, what, about 8 years ago in reality?

Well hey, now the rich and 'ruling elite' playboys will have to obey the same laws of the land as the poor boys do.  :D

I wish Mark McInnes had touched me up - Alannah Hill

. Designer makes light of sex scandal
. Wishes McInnes had "touched her up"
. Lawsuit "a little glitch"
. Video: Alannah's rant
. In pictures: DJs Spring/Summer launch

FASHION designer Alannah Hill has described the $37 million David Jones sex harassment case as a "glitch", saying she would have gone back to the flat of "hot stuff" former CEO Mark McInnes "in a heartbeat".

In what started as an odd attempt to defend the store that stocks her garments, Hill outed herself as the "brunette" McInnes allegedly told former DJs publicist and alleged harassment victim Kristy Fraser-Kirk that he "could have had guaranteed sex with . . . last night but I wanted you". Hill said at the retail giant's spring/summer fashion parade yesterday.

>>>>> >>>>>

Yes, all depends if the gal fancies you or not. ;)

A "heartbeat" or "harassment"...a 'fine line' to tread!

XXXXXXXXXXXXXXXXXXXXXXXXXXXXXXXXXXXXXXXXXXXXXXXXXXXXXXXXXXXXXXXXXXXXXXXXXXXXXX

http://www.thesocialshuttle.com/

Alannah says of McInnes: " I threw myself at him. He told me he didn't want to mix business with pleasure." Yeah, sure.

Kristy Fraser-Kirk says McInnes phoned her one night wanting to have dinner with her and said he could have had sex with a brunette the night before.

"Yes I was the brunette, yes, yes I was the brunette," Hill said."He could have bedded me but he chose the other one. He is dreamy". Ahhh..sounds just like a dream .

Something tells me that Alannah Hill might have done herself a lot of damage from that ridiculous statement...think she may suffer foot in mouth disease....thought the man standing beside her (hill) when she was being interviewed looked somewhat uncomfortable.

In the light of 'day' she seems to have awoken and gone: "Oh my god, did I say that"?

So she's having a "sorry sale" this Saturday:

http://www.dailytelegraph.com.au/entertainment/designer-defends-hot-stuff-retail-boss/story-e6frewyr-1225900869029

Today Hill announced she would hold a “sorry sale” in her flagship Paddington store on Saturday, with half the proceeds donated to “some sort of a women's shelter or sexual abuse [charity]".

Asked what she would do with the other half, Hill said: I might pass them on to the nice girl with the hyphen in her name. I've forgotten her name."

XXXXXXXXXXXXXXXXXXXXXXXXXXXXXXXXXXXXXXXXXXXXXXXXXXXXXXXXXXXXXXXXXXXXXXXX

http://www.dailytelegraph.com.au/entertainment/designer-defends-hot-stuff-retail-boss/story-e6frewyr-1225900869029

Ms Fraser-Kirk has lodged a claim against Mr McInnes and DJs, alleging the former CEO was a serial sexual harasser and the store's board had breached its duty of care to protect her from him.

DJs will defend the claim.

While Hill last night released a statement saying her comments were "in jest" and not meant to trivialise a serious situation, praise for Mr McInnes came from other designers associated with the DJs brand.

Kaftan designer Camilla Franks said she continued to respect Mr McInnes and that there's "always two sides to every story. I adore Mark".

Yesterday's show seemed to suffer from the loss of its two star attractions - the charismatic McInnes and honeymooning catwalk queen Miranda Kerr who is resting in the US after marrying actor Orlando Bloom.

>>>>> >>>>>

Seems many women in the fashion social set here and abroad adore/d the charismatic Mark.

>>>>> >>>>>

Maybe she was indeed besotted with him and got carried away with her 'dream' while the cameras were rolling....then later woke up and remembered where she was...and what had actually happened.

She seems to be one of those eccentric and brilliant type gals.

Expletive laden language is common in many workplaces among mixed sex staff...and a lot of it is used by women!

Should be interesting.

Don't like his chances too much after this!!!

http://www.smh.com.au/business/dont-ruin-my-life-mcinnes-20100930-15yxr.html?autostart=1

The content of his June 14 texts and voicemails, as set out in a letter by Ms Fraser-Kirk's lawyers, was released by the Federal Court on Thursday.

In a 6.01pm voicemail, he said: "Kristy, I met with the Board today and this is going to be really bad for me Kristy.

"My job, my livelihood, my relationship, please if there is any way I could talk to you before you go through with this tomorrow, I would really like to".

He later said he knew he made a mistake and apologised for it, adding "I know the company will pay compensation".

In a 6.30pm text, he wrote: "I am pleading with you to show some mercy on me by tmrw morning ...or everything I have worked for or earnt is gone, I will be totally destroyed".

"I no my attempt to kiss u ws wrong and im so so so so sorry, but I am about to lose everything I have in my life ... please, please, please, please have some compassion on me and we will settle this as you wish".

It isn't shocking to me that he tried one last ditch attempt to avert court proceedings, and might have even been advised to do so by his lawyers.... but maybe if he had been a little less me, me, me...I am losing everything, I won't have this, I will lose that...this isn't really about him. He doesn't get that - even now. If I had read those emails/SMS I just would have thought 'what a selfish git, did he think about me? At any point did he think about me?' With his head I mean...

I think 35m is extreme, don't get me wrong, but if this is how he handles things...pfft!

No Chris it does not.

What she is saying is I went to you David Jones my employer.

You were not interested in doing the right thing by me your employer.

When things did get tough you then gave him a 2million dollar payout.

If I sue you for 2 million that is chickenfeed for you whereas if I sue you for 35million and the ex CEO for 2 million, in future when a junior employee makes a complaint you may well listen and do something about it.....

I think the 2 million that they paid out to him may have been the turning point. David Jones need to treat women that work for them with more respect.
