Seems to me he's being hung, drawn and quartered by Abbott before there's any sort of judicial inquiry. The real 'joke' is that Turnbull was up for the same 'offence' but was allowed to keep working while it was sorted out!! Hypocrisy at its worst.

I think perhaps some of you are not thinking through what these comments are about...from a personal point of view it isn't all about Fraser-Kirk in particular; it isn't about the dollars...it is about the fact that in here in Australia a law was passed whereby women or men do not have to put up with harassment of a sexual nature. I understand that some women/men might just fob any problem co-workers off but not everyone feels confident enough to do this. All of these years later I am still picking up vibes from people (both here & in general conversation) that it is still okay to try .... it is also obvious that DJ's shared that view, given that they chose to ignore Fraser-Kirk. One would hope that it Fraser-Kirk does go on & win her case against the former CEO & DJ's that management in other workplace situations throughout Australia will take notice.

http://www.hreoc.gov.au/sexualharassment/index.html

Sexual harassment

Despite 24 years of legislation, sexual harassment remains a problem in our workplaces. Sexual harassment comes at a considerable cost, both to affected individuals and to business. It is important that employers take active steps to prevent sexual harassment and respond effectively when it occurs.

Sexual harassment is defined in the Sex Discrimination Act 1984 (Cth) as ‘any unwelcome or unwanted sexual behaviour which makes a person feel offended, humiliated and /or intimidated where that reaction is reasonable in the circumstance’.

    *      A national telephone survey conducted by the Australian Human Rights Commission in 2008 has found that 22% of females and 5% of males had experienced sexual harassment in the workplace at some time, compared to 28% of females and 7% of males in 2003.

    *      The 2008 survey also found a lack of understanding as to what sexual harassment is. Around one in five (22%) respondents who said they had not experienced ‘sexual harassment’1 then went on to report having experienced behaviours that may in fact amount to sexual harassment under the Sex Discrimination Act 1984 (Cth).

    *      In the 2008 national telephone survey, only 16% of those who have been sexually harassed in the last five years in the workplace formally reported or made a complaint, compared to 32% in 2003.

    *      Nearly one in five complaints received by the Australian Human Rights Commission under the Sex Discrimination Act 1984 (Cth) relate to sexual harassment. The vast majority of these take place in the workplace.

Name one successful sexual harrasment case wherre a male was the victim of a female?

Not sayng that there haven't been any, just pointing out that these sorts of things do tend to have a pro-female perspective, especially in the media.

The above shows how the media tends to colour things.

Regards,

Crismon

There's clearcut sexual harassment in the workplace ...as shown in the movie North Country...starring Charlize and Woody...where it all began...Minnesota USA...in the mines...where the women won their sexual harassment case, received a modest settlement, and the ensuing laws travelled around the world.

North Country (2005, trailer)

*

There's False accusations.

*

And there's all the other stuff in between...the sexual flirting, inappropriate attire, sexual email jokes sent around, sexual talk and innuendo in the office and at work functions, Christmas parties etc, ...where often alcohol provided by the employer flows like water, ...with women 'coming on' to co-workers and bosses for favours, promotions etc.
You get one life. What you do with it, and what is done to you...you have to live with that.

Don't like his chances too much after this!!!

http://www.smh.com.au/business/dont-ruin-my-life-mcinnes-20100930-15yxr.html?autostart=1

The content of his June 14 texts and voicemails, as set out in a letter by Ms Fraser-Kirk's lawyers, was released by the Federal Court on Thursday.

In a 6.01pm voicemail, he said: "Kristy, I met with the Board today and this is going to be really bad for me Kristy.

"My job, my livelihood, my relationship, please if there is any way I could talk to you before you go through with this tomorrow, I would really like to".

He later said he knew he made a mistake and apologised for it, adding "I know the company will pay compensation".

In a 6.30pm text, he wrote: "I am pleading with you to show some mercy on me by tmrw morning ...or everything I have worked for or earnt is gone, I will be totally destroyed".

"I no my attempt to kiss u ws wrong and im so so so so sorry, but I am about to lose everything I have in my life ... please, please, please, please have some compassion on me and we will settle this as you wish".

Not a bad offer though...a grovelling apology, compensation, keep your job, and life goes on.

She chose to go in another direction, into the limelight...the bright lights of the newspapers, electronic media, and the courts.

I don't wish to make further comment...however thankyou Patricia, Sandpaper and Jen for your input....I am however so dissapointed at some of the males on this forum...I guess some things will never change...

Why are you 'so disappointed'?
Because some males don't just automatically believe every woman who alleges sexual assault?

Each court case is different...including each case of alleged sexual assault/sexual harassment.

MARK McInnes was one of the Sydney social whirl's most eligible divorcees.

Handsome, superfit from his morning runs along Bondi Beach, charming and well-connected as the head of luxury department store chain David Jones, he was a bit of a flirt.

Most women went along with it, enjoyed it even. It was part of that double air kiss social scene schmoozing that went with the job.

Mark McInnes' ex-files

DISGRACED David Jones boss Mark McInnes' first wife has warned young women not to have office affairs with lecherous bosses.

Ingrid Gibbons, who married Mr McInnes in her early 20s, said powerful men like her ex-husband often attracted the attention of junior women at work.

>>>>> >>>>>

They do...it is often the money, power, shopping sprees, luxury cars, fancy dinners, VIP functions, an exalted place in society and a chance to advance their careers that attracts the junior women, and not so junior women.

When the affair ends, most of the women see it for what it was, an affair from which both gained benefit.

The junior men at work their own age and class 'never' have a chance of attracting the attention of the junior women.

David Jones sexual harassment case could be settled

THE $37 million sexual harassment case against David Jones could be settled in secret on Friday.

A conciliation hearing between store publicist Kristy Fraser-Kirk, former CEO Mark McInnes and the DJs board has been scheduled for that day in the Australian Human Rights Commission in Sydney.

Mr McInnes and the retail giant have denied the claims and they are being vigorously defended

Justice Geoffrey Flick accused her lawyers of "vacillating".

"It's a comparatively simple case. It's either factually right or wrong," said the judge.

Conciliation before the Human Rights Commission is not open to the public.

>>>>> >>>>>

Human Rights Commission?

Crikey!

What, they gonna 'hide' it in there so no one knows what the final outcome is?

They're dragging up stuff he's alleged to have done at another workplace 20 years ago...at age 21?

At one office Christmas party [with spouses and BFs and GFs in attendance] we had a girl in a very skimpy bikini showing us all her newly acquired gymnastic skills, doing rolls on a floor mat. :D

Don't think that would be acceptable these days.

David Jones hit with bill for Kristy Fraser-Kirk's New York escape

. Publicist includes airfare in harassment suit
. She claims she had to escape media attention
. Case may be settled behind closed doors now

PUBLICIST Kristy Fraser-Kirk has sent a bill for her airfare to New York to David Jones as part of her record sexual harassment claim.

Ms Fraser-Kirk has included the trip to the seaside playground of the Hamptons, during which she attended a family wedding, on a list of expenses which she claims were necessary to escape the "enormous" media attention in Sydney.

She remains on the David Jones payroll despite her $37 million claim against her employer.

Also on the expenses list is an earlier flight to London and a number of taxi fares. Ms Fraser-Kirk, 27, met parents Alex and Sally in the Hamptons and photographs of her smiling and apparently relaxed were posted on Facebook.

I do, at least.

I don't get at all why it's in the Human Rights Commission.

It's a workplace sexual harassment trial...'punitive damages' being sought...with each side having  competent legal representation.

Kristy Fraser-Kirk and the $8 million rumour

AFTER refusing an early offer of $850,000 to settle the Mark McInnes David Jones sexual harassment case and save all parties public embarrassment, this column has been informed Kristy Fraser-Kirk has now knocked back a revised offer of $8 million to settle ahead of this week's conciliation talks.

That figure is the exact amount Fraser-Kirk originally sought in damages from the department store prior to her legal team Harmers' pursuit of a punitive claim of $37 million.

Sources within David Jones said the new offer was made last month before Fraser-Kirk left the country for a holiday in the Hamptons. Yesterday David Jones denied the offer had ever been on the table.
